Terms of Service
By purchasing or using a personalized book from Heart Surprise LLC ("Heart Surprise," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, please do not purchase or use our products.
By placing an order, submitting content through our order form, or using our website and services, you confirm that you have read, understood, and agree to be bound by these Terms.
You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract to purchase from us. By placing an order that includes a child's name, details, or photograph, you confirm that you are the child's parent or legal guardian, or that you have the permission of the child's parent or legal guardian to provide that information and to have a personalized book created using it.
Our books are created using a combination of custom AI-generated content and human oversight. Both the written story and the illustrations are produced with this technology. We offer a digital book and optional printed copies (paperback or hardcover, black-and-white or color, depending on the book type). Because our illustrations aim to capture a likeness of the characters you provide, results are interpretive and will not be photographic reproductions.
Every book begins as a digital book. After you submit your order details, you will receive links by email to review your book before it is finalized:
You approve the finished book before any printed copy is produced. Printed copies are made to order only after your approval. It is your responsibility to review your book carefully at each stage; by approving, you confirm the content meets your expectations.
Prices are shown at the time of purchase on our website and order form. Your digital book is a separate purchase from any printed copies. Prices for printed copies depend on format (paperback/hardcover and black-and-white/color) and the book type you choose. Shipping costs are calculated at checkout and vary by destination. Payment is processed by a third-party payment provider; by purchasing, you agree to that provider's terms as well.
Requests for sexually explicit content, content that sexualizes or endangers minors, hateful content, or content that promotes violence or illegal activity are strictly prohibited. If such content is requested, it will not be produced, your order may be cancelled, and no refund will be issued.
We work to incorporate the details you provide and to reflect your specified characters and settings. However, because of the inherent limitations of AI-generated content, minor discrepancies may occur, even after human review and your own review and approval. By purchasing, you acknowledge and accept these potential variations.
All rights, including copyright, in the stories, illustrations, and other content we produce are owned exclusively by Heart Surprise LLC. We grant you a personal, non-exclusive, non-transferable, non-commercial license to enjoy, print for personal use, and share your finished book with family and friends. You may not resell, redistribute commercially, or create derivative products from your book without our written permission.
We will not use your finished book, its illustrations, or the photos you provide for our marketing, promotional, or advertising purposes unless you give us your explicit permission (for example, by opting in at checkout or in writing). If you do opt in, you grant Heart Surprise LLC a royalty-free license to use that content for marketing across any medium, with no additional compensation, and you may withdraw that permission for future use at any time by contacting us.
10. Shipping and Delivery
Digital books are delivered electronically via download or a secure link. Printed copies are produced and shipped by a third-party print-on-demand and fulfillment partner. Production and delivery times and shipping costs vary and are shown at or before checkout. Once a printed order is handed to the carrier, delivery timing is outside our control.
Because each book is custom-made to order and you review and approve it before any printed copy is produced, all sales are final and we do not offer refunds, except where required by law or in the case of a genuine production defect (for example, a printing or binding error). If you receive a printed copy with a manufacturing defect, contact us at info@heartsurprise.com within 14 days of delivery and we will work with you to correct it.
We respect your privacy and the sensitivity of the information and photos you share. We do not sell your personal data. We share it only with the service providers needed to create and deliver your order. Our handling of your information, including how long we keep uploaded photos, is described in our Privacy Policy. Please review it; by purchasing, you also agree to that policy.
Our products are provided "as is." To the fullest extent permitted by law, Heart Surprise LLC is not liable for discrepancies between your input and the final product that arise from the limitations of AI-generated content, nor for indirect or consequential damages. While we use AI technologies together with human oversight to keep content appropriate, the variability of AI systems means there is a small risk that content some may find unintended or offensive could appear despite our review. By purchasing, you acknowledge and accept this risk. Your feedback is welcome and we will review any concerns, but feedback does not entitle you to a refund except as described in Section 11.
You agree to hold Heart Surprise LLC harmless from, and indemnify us against, any claims arising from content you provided, from your breach of these Terms, or from your use of your book in violation of these Terms.
Our referral, fundraiser, and influencer programs are offered under separate program terms. Participation, eligibility, tracking, and payout of any referral compensation are governed by those separate terms, which we may update from time to time.
We may modify these Terms at any time. Changes take effect when posted. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Indiana, USA. Any disputes arising from these Terms will be resolved in the state or federal courts located in Indiana, and you consent to their jurisdiction.
